Don't Consent To a Search; Be Smart Rx Pot Patients

by "Alan B. Mac Farlane" <alanb@[EMAIL PROTECTED] > Jun 3, 2008 at 04:53 PM

Dear Medical Patients.

Many arrests for cannabis possession are due to traffic violations and
noise
complaints.

TRAVEL SAFETY: Do not smoke and drive. If you travel with medical
cannabis, make sure your vehicle is up to code and your medicine is
concealed, preferable in your trunk.

BE PREPARED: Carry your recommendation and state-issued ID Card (if you
have one) at all times, but do not present it to law enforcement unless
accused of a marijuana-related crime (see below)

BE DISCREET: Try not to medicate by smoking where others can see you and
never leave canabis items in plain view.

EXERCISE YOUR RIGHTS !!!

There are three levels of police interactions and safe ways to handle each
encounter. Remember these people are authorized to shoot you or tazer you
repeatedly until you die so misunderstandings are dangerous.

1. Casual conversation: Ask if you are being detained. If not, walk
away.

2. Detention: If you are being detained, ask why! Make them cite the law
(and remember what they say)!

3. Arrest: Say "I choose to remain silent and I want to see a lawyer".
(Remember to remain silent).

DON'T CONSENT TO A SEARCH !!!

If the cops say in casual conversation "Do you mind if I look in your
purse,
bag, home, car, trunk, drawers ... etc ... trying to trick you in.

You say, "I do not consent to a search."

If the cops then say "Why not ? Are you hiding something ?" trying to
trick
you more.

You clear things up more by saying "I believe in my Constitutional right
to
privacy, and I do not consent to a search."

NOTE: This probably will not stop one bit an officer of the law from
searching you; but it can help get any evidence thrown out of court.

SEARCH WARRENTS:

Do NOT let any uniformed officer of the law into your home without a
search
warrent. Check the address, the date (relatively recent). and a judge's
signature.

If law enforcement knocks on your door, step outside and close the door
behind you while you find out why they are there. Don't leave the door
wide
open.

If they do enter your home, with or without a search warrent, say, "I do
not
consent to a search".
