I've no idea what you're trying to say here, that sentence makes no sense.

They aren't all criminal under 8USC1325; for the small minority in 
question, I don't know the status of their offenses under the other 
statutes.

What are the numbers? It's certainly a small minority as I said, and 
I'll be surprised if it's a large absolute number. Bear in mind that 
many people will claim to be in this category who actually had intention 
to stay when they entered. Also bear in mind that a common reason for 
being in this category is falling in love with someone after entering 
the USA and deciding to stay with them. If they subsequently marry a USC 
and receive a Green Card by marriage, the offenses associated with the 
unplanned overstay are forgiven and they become legal immigrants.
