Haven't capitulated at all.  The radical right majority on the Court made
up
new law in their decision, flying in the face of the history of the Bill
of
Rights and 200+ years of jurisprudence.

But until it's overturned, it's the law of the land.  When those who
believe
in the Constitution rather than the radical right agenda regain a majority
of the Court, this will be seen as the aberration it is.
