No it doesn't and you are correct.

Try the criminal for the act, not what he THINKS about the act.

Perhaps there should be special penalties for TORTURE (and some
jurisdictions do have ways to make allowance for these kinds of
distinctions.)

I don't care where a mugger attacks me for my wallet or my skin
color; if he tries (or even succeeds) then he should be tried for
the assault, and any other physical crime he commits in performaing
that assault.
